This Writ Petition is filed challenging the impugned order passed by the third respondent in proceedings No.Ni.Mu.AA4/291/2024 dated 2/6
23.01.2024 and consequently direct the third respondent to grant Patta in the petitioner's name with respect to the land comprised in Survey Number 1682/16 measuring to an extent of 0.0095.0 sq.ms situated at Melarajakularaman Village, Rajapalayam Taluk, Virudhunagar District.
2. It is the grievance of the petitioner that the petitioner is in absolute possession and enjoyment of the subject property. Without issuing any notice and without following due process of law, the third respondent has passed the impugned order changing the patta in favour of the sixth respondent. Hence, the petitioner has approached this Court. 3.The sixth respondent had earlier filed W.P(MD) No.23251 of 2017, in respect of the subject land. The said writ petition was closed by order dated 04.09.2024 recording that assignment had already been granted in favour of the temple and that the temple has also paid the market value for the land. The petitioner herein is claiming patta for the very same land. Further, the petitioner's brother had earlier approached the Civil Court seeking declaration and permanent Injunction in respect of the subject property. The said suit was also dismissed on 12.03.2021. 3/6
Since no relief was granted by the Civil Court, the petitioner has approached this Court for the above said relief. The issue has already been decided by the civil Court. Therefore, the question of granting any relief in the present writ petition does not arise. Accordingly, this Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
