ORDER : The Court made the following order :- The petitioner/Accused herein, who was arrested on 11.07.2022 for the alleged offence under Sections 294(b), 302 IPC @ 294(b), 302, 120(B), 342 IPC, in Crime No.133 of 2022, on the file of the respondent police, seeks bail.

2.The allegation against the petitioner is that due to dispute regarding irrigation of water, A1 and A2 conspired together, A2 caught hold of deceased, A1 attacked him with spade. Hence, this murder case was registered against the accused persons. 3.On the side of the petitioner it is stated that the petitioner is in custody from 11.07.2022. The petitioner is A1. A2 was arrested and released on bail. Investigation was over and charge sheet was filed and taken on file as PRC No.66 of 2022. The https://www.mhc.tn.gov.in/judis

petitioner also sustained injury and he took treatment in the hospital. Hence, prays to release him on bail. 4.On the side of respondent, it is stated that only due to land dispute among the brothers, the petitioner and other accused murdered the deceased. A2 was already released on bail by the lower Court and the investigation was over in this case. 5.The allegation against the petitioner is grave in nature. Considering the nature of offence and considering the period of incarceration, this Court is not inclined to release the petitioner on bail.

6.Accordingly, this Criminal Original Petition stands dismissed.
