PRAYER: Writ Appeal filed under Clause 15 of Letters Patent, praying this Court to allow the writ appeal by setting aside the order dated 23.06.2025 in W.P.(MD)No.3410 of 2025 on the file of this Court. For Appellant : Mr.Dr.R.Alagumani For Respondents : Mr.A.Kannan Additional Government Pleader

ORDER

(Order of the Court was made by G.R.SWAMINATHAN, J.) Heard both sides.

2. The appellant herein was working as Superintendent in the office of the Public Works Department, Sub Division, Madurai Region. Vide order dated 29.01.2025, he was transferred to Devakottai. The writ petitioner successfully obtained interim order. The writ petition eventually came to be dismissed on 23.06.2025. Aggrieved by the same, this writ appeal came to be filed.

3. The learned counsel appearing for the appellant tried to argue that since the appellant's children are studying, transfer cannot be made during the middle of the academic year. This argument is not available to the writ petitioner because the transfer order was made on 29.01.2025 and the same was also stayed. Now, a new academic year has commenced. The transfer order is not at all stigmatic. It has been made for administrative reasons. If the transfer order has been made for punitive reasons, the writ Court would be justified in interfering. The learned single Judge had rightly dismissed the writ petition and interference with the said order is not called for. The writ appeal is dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
