PRAYER :- For Bail in Crime No.142 of 2017 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Accused No.3 herein, who was arrested on 07.11.2022 for the alleged offence under Sections 394 of IPC, in Crime No.142 of 2017, on the file of the respondent police, seeks bail.
2.It is submitted that the petitioner was arrested and remanded in this case and further he was granted bail. After completing the investigation, charge sheet was laid 1/3
by the respondent police before the learned Judicial Magistrate No.II, Kumbakonam and the same was taken cognizance in C.C.No.12 of 2018. Thereafter, it was transferred to the file of learned Judicial Magistrate, Thiruvidaimaruthur. Again it was transferred to the file of learned Judicial Magistrate No.II, Kumbakonam and renumbered in C.C.No.130 of 2020 for the offence chargeable under Section 394 r/w 397 of IPC. Due to absence of the petitioner Non bailable warrant was issued against the petitioner on 05.04.2022. Hence, on execution of the above said warrant, the petitioner was again arrested on 07.11.2022. Now the case is committed against the petitioner and other accused to the learned Subordinate Judge, Kumbakonam in S.C.No.141 of 2023.
3.The learned Additional Public Prosecutor would submit that the petitioner is having 24 previous cases. Considering the bad antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner. 4.The learned counsel for the petitioner would submit that though this petition has been filed seeking bail, he will be satisfied if a direction is issued to the trial Court to complete the trial process within a stipulated time. 5.In view of the above said submission, there shall be a direction to the learned Principal Subordinate Judge, Kumbakonam, to expedite the trial process in S.C.No.141 of 2023, pending on his file and complete the same, within a period of 2/3
four months from the date of receipt of a copy of this order. 6.With the above said directions, this criminal original petition stands dismissed.
