This Criminal Original Petition has been filed to quash the First Information Report in Crime No.340 of 2021 on the file of the first respondent.

2. When the matter is taken up for hearing today,the learned Additional Public Prosecutor represented that after investigation the respondent police has closed the case as ' Mistake of Fact '.

3. The learned counsel appearing for the second respondent represented that no notice was served on the defacto complainant.

4. In view of the fact that already negative report was filed , this Criminal Original Petition stands closed. Consequently connected miscellaneous petition is closed. It is for the trial court to issue notice to the second respondent in the manner known to law. After receipt of notice the second respondent can work out remedy in the manner known to law.
