O R D E R

The prayer in the writ petition is to direct the respondents 1 to 4 to stop functioning of the power loom unit run by the fifth respondent in Door No.87, Muthaliyarpatti Street, Srivilliputhur, Virudhunagar District without obtaining license from the respondents 1 to 3.

The learned counsel appearing for the petitioner would submit that he has given representation dated 15.05.2023 to stop functioning the power loom unit run by the fifth respondent in Door No.87, Muthaliyarpatti Street, Srivilliputhur, Virudhunagar District. He would further submit that power unit is not permitted to run in the residential area but in violation of the same, the fifth respondent is 2/5

running the power loom unit, hence he has given the representation to the respondents. However no steps was taken by the respondents. However he would submit that he has given a representation two years before hence he may be permitted to give a fresh representation.

3. The learned counsel appearing for the third respondent would submit that in the present case they have nothing to do in the present petition. If they receive any order from the Commissioner or the Disrict Collector they will stop functioning the unit.

4. Now it is seen that the representation given by the petitioner dated 15.05.2023 is closed. In view of the same, this Court directs the petitioner to give a fresh representation to the respondent 1 to 3 and on receipt of the same, the respondents 1 to 3 are directed to consider the fresh representation and pass orders taking into consideration whether the power loom unit is run by the fifth respondent is permissible in the residential area.

5. With the above direction, the Writ Petition stands disposed of. No costs.
