4.T.Vanmathi ..Respondents PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the 1st respondent to instruct the respondents 2 and 3 not to harass the petitioners under the guise of enquiry without any case. For Petitioners : Mr.R.Narayanan For R1 to R3 : Mr.B.Thanga Aravindh Government Advocate (Crl.side) O RDER This petition is filed seeking for a direction to the respondent Nos.2 and 3 police not to intervene in the matrimonial dispute between the petitioners and the respondent No.4.

2.According to the learned counsel for the petitioners, the wedding between the petitioner No.1 and the respondent No.4 was solemnized on 09.06.2022 and subsequently, disputes arose between the petitioner No.1 and the respondent No.

4. On account of the attitude of the respondent No.4, all the mediation efforts have been failed and the respondent No.4 during the course of counselling proceedings has made an attempt to commit suicide. Considering the 2/6

circumstances, the petitioner No.1 has moved HMOP.No.832 of 2023 on the file of the Family Judge, Madurai seeking divorce and the same is pending. 3.It is submitted further that on account of the issues between the petitioner No.1 and the respondent No.4, on a complaint given by the respondent No.4, the respondent Nos.1 to 3 police are insisting the petitioners to take the respondent No.4 back to the family of the petitioners. It is submitted that the respondent No.4 has already threatened thrice that she will commit suicide and the petitioners are apprehending that in case if she commits anything in their house, then all the petitioners will be in trouble and that the dispute is seized by the Family Court, suitable directions are sought for.

4.The learned Government Advocate (Crl.side) submits that basing on a representation given by the respondent No.4, an enquiry is initiated in C.No. 27/AWPS/TILM MC/23 dated 29.05.2023 and summons were issued to the petitioners, but both the parties failed to appear and the learned Government Advocate (Crl.side) has submitted that the police will complete the investigation shortly.

5.Considering the fact that the dispute between the petitioner No.1 and the respondent No.4 is purely a matrimonial one and since the matter has already been seized by the family Court, the respondent police are directed to dispose of the representation of the petitioner dated 19.07.2023 as quickly as possible, not later than two weeks from the date of receipt of a copy of this order by following due process of law.
