O R D E R
[Order of the Court was made by N.ANAND VENKATESH, J.] This Writ Petition has been filed for issuance of Writ of Mandamus, directing the first respondent to consider the representation dated 11.05.2026 and grant ordinary leave for 21 days without Police escort to the petitioner's brother, who is serving sentence at Central Prison, Trichy.
2. Heard the learned counsel for the petitioner and the learned Counsel for State of TN (Crl.Side) appearing on behalf of the respondents.
3. The petitioner is the brother of the convict. The petitioner's brother is undergoing life sentence at Central Prison, Trichy. A representation was made by the petitioner seeking ordinary leave on the ground that his mother is suffering from health ailments and she requires the physical and emotional support of the convict. Since the representation was not considered, the present Writ Petition has been filed before this Court.
4. At the time of hearing, the learned Counsel for State of TN (Crl.Side) appearing on behalf of the respondents produced the proceedings of the first respondent, dated 18.06.2026, wherein the first respondent has granted 21 days ordinary leave with Police escort.
5. The learned Counsel for State of TN (Crl.Side), on instructions, submitted that the convict has undergone sentence of 4 years, 2 months and 26 days and that, till now, no leave has been sought for.
6. Taking into consideration the reason, for which the ordinary leave has been sought, we are inclined to modify the condition imposed by
the first respondent to the effect that the convict shall report before the 4th respondent Police daily at 5.00 PM during the entire ordinary leave period. The other conditions shall stand as they are and the sureties shall be executed before the jail authorities.
7. It is made clear that during the ordinary leave period, the convict shall not cause any disturbance to the victim girl and her family.
8. This Writ Petition (Criminal) is allowed with the above directions. No costs.
