ORDER : The Court made the following order :- The petitioners/A3 and A4, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 498(A), 406 and 506(i) of IPC and Section 4 of Dowry Prohibition Act, 1961, in Crime No.17 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that the petitioners along with other accused harassed the de-facto complainant by demanding additional dowry. Hence, the complaint.

3.The learned counsel for the petitioners would submit that the petitioners are innocent and they have been falsely implicated in this case. In order to harass the petitioners, the defacto complainant implicated them in the present FIR. Hence, he prays for anticipatory bail.

4.The learned Government Advocate (Crl. side) would submit that the marriage between the de-facto complainant and the first accused was solemnized on 06.11.2020 and after marriage, she was subjected to cruelty by the petitioners by demanding additional dowry. Hence, he strongly opposed to grant anticipatory bail to the petitioner. 5.The learned counsel for the intervenor vehemently opposed for grant of anticipatory bail to the petitioners. 6.Considering the facts and circumstances of the case and also considering the fact that it is a matrimonial dispute between the first accused and the defacto complainant and the petitioners are only relatives of the first accused, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. 7.

Accordingly, the petitioners are ordered to be released on bail in the event of arrest or their appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate, Tenkasi, on condition that the petitioners shall execute a bond for a sum of Rs.

(a)the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

(b)the petitioners shall report before the respondent police daily at 10.30 am until further orders.

(c)the petitioners shall not tamper with evidence or witness either during investigation or trial;

(d)the petitioners shall not abscond either during investigation or trial;

(e)on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;

(f)if the accused thereafter abscond, a fresh FIR can be registered under Section 229-A IPC.
