This petition has been filed to direct the learned II Additional District and Sessions Judge cum P.C.R.Court, Tirunelveli District to consider and dispose of the bail application to be filed by the petitioner on the same day of its filing on his surrender in connection with the case in Crime Nos.299 of 2021 on the file of the Inspector of Police, Valliyoor Police Station, Tirunelveli District.

2. When the matter is taken up for hearing today, Mr.RMS.Sethuraman, learned Additional Public Prosecutor who accepts notice for the respondents 1 and 2 submits that even though the injured person was discharged from the Hospital, totally 12 previous cases are pending against the petitioner, out https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.15479 of 2021 of which, 4 cases disposed of, 4 cases pending for trial and 4 cases yet to be taken on file.

3. Considering the facts and circumstances of the case and also taking into consideration the antecedents of the petitioner, this Criminal Original Petition is dismissed as discretionary rating is not available to the petitioner.
