Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents, particularly the 3rd and 4th respondents, to take note of petitioners representation dated 30.03.2026 and to make necessary corrections in the registration records relating to Sale Deed bearing Document No.389/2000 dated 07.02.2000, pertaining to Patta No.589, R.S.Nos. 12/2 and 12/4, Plot No.95, by substituting petitioners correct name P. Venkatesan in place of the wrongly recorded name P. Venkatesh, and consequently permit and register an appropriate Deed of Rectification in accordance with law or in any manner known to law.

ORDER

The writ petition has been filed seeking the issuance of a writ of mandamus directing respondents 3 and 4 to consider the petitioner's representation and to make the necessary corrections in the registration records pertaining to the Sale Deed registered as Document No. 389 of 2000, dated 07.02.2000.

2. Upon hearing the learned counsel for the petitioner, it is submitted that in the aforementioned Sale Deed, the petitioner's name has been erroneously 2/6

mentioned as "P. Venkatesh" instead of "P. Venkatesan." Owing to this discrepancy, the petitioner is facing various difficulties. The petitioner was unable to trace the vendor for the purpose of rectifying the error in the Sale Deed. Therefore, the petitioner submitted a representation to the concerned authority seeking correction of the mistake. Since no action has been taken on the said representation, the petitioner has approached this Hon'ble Court by filing the present writ petition.

3. The registration records can only contain the name exactly as it appears in the sale deed. The Registrar has no authority to alter or modify the contents of the registered document. If the petitioner faces any difficulty on account of the discrepancy, it is open to the petitioner to establish that the difference between "P. Venkatesan" and "P. Venkatesh" is merely a typographical error and that both names refer to the same person. Being only the purchaser, the petitioner may overcome the issue by producing appropriate evidence to that effect. However, if the petitioner seeks correction of the name in the sale deed itself, the petitioner must approach the vendor for appropriate rectification.

4. Even, if the vendor is not cooperating or could not be found out, the petitioner has to approach the appropriate Civil Court with the prayer of 3/6

mandatory injunction to execute rectification deed and the Civil Court will serve the notice as per law and thereafter, the decision will be taken.

5. Without doing so, the petitioner cannot make a representation and request the Sub-Regiarar to change the name in the registration records and such a prayer cannot be countenance.

6. With the aforesaid liberty to the petitioner, the writ petition stands disposed of. No costs.
