Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.230 of 2023 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/1st accused, who apprehends arrest at the hands of the respondent Police for the alleged offences punishable under Sections 397 of IPC, in Crime No.230 of 2023 on the file of the respondent police, seeks anticipatory bail. 1/4
2.The case of the prosecution as per the defacto complainant version is that he was working with the first accused/petitioner. On the date of above said occurrence, the defacto complainant collected Rs.10,000/- belongs to the company. After that, the accused persons took the defacto complainant to the remote place, the accused persons attacked the defacto complainant and asked the amount, but the same was refused by the defacto complainant. Thereafter, threatened with dire consequences. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is innocent person and he has not committed any offence as alleged by the prosecution. Due to previous enmity, the petitioner was falsely roped into this case. 4.Reading of the First Information Report shows that some sort of affair existing between this petitioner, defacto complainant and others. On that ground only, the defacto complainant took this petitioner in his two wheeler. At that time, the above said occurrence said to have taken place.
5.The learned Government Advocate (Crl.Side) would submit that subsequent to the above said case, another complaint has been registered in Crime No.229 of 2023 against this petitioner for similar nature of offence. 6.Considering the facts and circumstances of the case and also considering the bad antecedent of this petitioner, this Court is not inclined to grant anticipatory bail 2/4
to the petitioner.
