ORDER : The Court made the following order :- The petitioner/Accused Rank not known, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 379 of IPC, in Crime No.276 of 2023, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant lodged a
complaint stating that she engaged one AC mechanic and this petitioner for making repairs and other works. On 03.07.2023, AC mechanic came inside the house and made repair. This petitioner was working outside the house. At about 4.30 p.m., both of them after finishing their work went away. At the time, the defacto complainant found her 5 sovereigns of gold jewel was missing. Se made enquiry with the petitioner and also the AC mechanic. Both of them are not property giving reply. On suspicion she has given a complaint against the above said AC mechanic and this petitioner.
3. The learned counsel for the petitioner submitted that he is an innocent, he has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution. No preliminary enquiry was conducted.
4. The learned Government Advocate(Crl.side) submitted that FIR has been registered after conducting enquiry. 5 sovereigns of gold jewel was not yet recovered.
