Heard the learned counsel on either side.

2. The petitioner seeks re-issuance of passport. However, the first respondent has kept the application pending in view of the pendency of the criminal case against the petitioner.

The learned Special Government Pleader appearing for the second respondent would point out that C.C.No.202 of 2015 is pending on the file of the Judicial Magistrate No.II, Kovilpatti.

The petitioner is permitted to move the jurisdictional Magistrate with an appropriate prayer and the learned Magistrate shall dispose of the same on merits and in accordance with law within a period of three weeks after the miscellaneous petition is filed.

5. I make it clear that I have not gone into the merits of the matter. With this liberty to the petitioner and the direction to the jurisdictional Magistrate, this writ petition stands disposed of. No costs.
