PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus directing the Respondents to permit the petitioner to receive family pension of father in law namely, Chellaiah on behalf of the Petitioner's brother in laws namely, Salaikumar and Kanagaraj based on the Petitioner's representation, dated 05.07.2024 within time frame fixed by this Court. ORDER

Heard Ms.M.Perumal, learned counsel for the petitioner, Ms.S.Mahalakshmi, learned Standing Counsel appearing for the first respondents and Mr.S.Shanmugavel, learned Additional Government Pleader appearing for the respondents 2 and 3.

2. By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself. 2/6

3. The petitioner sent a representation dated 05.07.2024 to the respondents requesting them to permit the petitioner to receive family pension of the petitioner's father-in-law namely, Chellaiah on behalf of his brother-in-laws namely, Salaikumar and Kanagaraj. Since the said representation was not considered by the respondents so far, the petitioner has filed the present writ petition. 4.The learned Standing Counsel appearing for the first respondent and the learned Additional Government Pleader appearing for the respondents 2 and 3 submitted that the representation of the petitioner would be considered by the respondents within a time frame fixed by this Court.

5. In the light of the above observations, this writ petition is disposed of and the respondents herein are directed to consider the petitioner's representation dated on 05.07.2024 on its own merits and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. It is made clear 3/6

that this Court has not gone into the merits of the claim of the petitioner and it is open to the respondents to consider the same on its own merits. No costs.
