ORDER

This Writ Petition is disposed of at the time of admission after hearing the learned counsel for the petitioner and the learned counsel for the respondentS.

2. It is noticed that the petitioner is the third accused in C.C.No.142 of 2020, which is pending before the learned Judicial Magistrate, Sivagiri, pursuant to the First Information Report registered in Crime No.309 of 2019 for the offences punishable under Sections 294(b), 323, 324, 355 and 506(i) of IPC.

3. Since the criminal case is pending against the petitioner in C.C.No.142 of 2020 on the file of the learned Judicial Magistrate, Sivagiri, there is no scope for directing the first respondent to issue a passport to the petitioner directly. However, the petitioner is at liberty to move an appropriate application before the learned Judicial Magistrate, Sivagiri, for appropriate orders for the first 2/4

respondent to process the application of the petitioner for issuance of the passport.

4. With the above liberty, this Writ Petition is disposed of. Consequently, connected Miscellaneous Petition is closed.
