Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Mandamus, to direct the 1st and 2nd respondent to expedite the enquiry initiated by the 2nd respondent vide Na.Ka.No.24/2022/A2 dated 11.04.2023 regarding the disbursement of compensation for the land acquired for the extension of National Highways No.209 and dispose of the same within the time limit stipulated by this Court.

ORDER

The petitioner, claiming to be the President of Arulmighu Maanur Irulappaswami Temple Trust, states that the land in Survey Nos.20/1 and 20/2 at Pethanayakkanpatti Village, Palani Taluk, Dindigul District, where the Temple is situated, was acquired by the National Highways authority for the extension of Pollachi and Dindigul in National Highway No.209. The petitioner has submitted a 2/5

representation dated 30.06.2022 to the second respondent seeking compensation. However, the 3rd respondent has raised certain objections for awarding compensation. Therefore, the second respondent has initiated an enquiry vide Na.Ka.No.24/2022/A2 dated 11.04.2023. The grievance of the petitioner is that the enquiry has not been concluded so far. Therefore, the petitioner has filed this writ petition for a Mandamus seeking a direction to the respondents to expedite the enquiry.

Mr.G.V.Vairam Santhosh, learned Additional Government Pleader appearing for the respondents 1 and 2 submits that during the enquiry, certain documents have been referred and therefore, the Revenue Divisional Officer has sought for certain clarification from the Village Officer. On receipt of the documents and details from the Village Officer, a final decision would be taken on the enquiry. 3/5

Considering the rival submission, this writ petition is disposed of with a direction to the second respondent to complete the enquiry as expeditiously as possible, preferably, within a period of four months from the date of receipt of a copy of this order.
