For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in crime No.242 of 2014 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner has filed this Criminal Original Petition seeking anticipatory bail. He apprehending arrested at the hands of the respondent police, in Crime No.242 of 2019. 2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent. 3.The learned Government Advocate (Crl. side) submits that as on date, the case has been registered. The case only under Section 174 of Cr.P.C., and no alteration has been made. There is nothing to implicate the petitioner as of now. Therefore, he wants to close this petition.

CRL OP(MD). No.12159 of 2019 4.I am of the view that some protection has to be given to the petitioner even while closing the petition. If the respondent intends to register an First Information Report against the petitioner, the respondent shall issue notice under Section 41 A of Cr.P.C. to the petitioner. This arrangement is directed so as to give breathing time to the petitioner to move this Court for the relief.

5.With these observations, the Criminal Original Petition stands disposed of.
