For Respondent : Mr.M.VAIKKAM KARUNANITHI, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No 431 of 2022 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under sections 498(A), 406 and 506(i) IPC and Section 67 Information Technology Act, 2000 on the file of the respondent police, seek/s anticipatory bail.

2. During the course of hearing, the learned counsel appearing for the petitioners submitted that on the basis of very same set of facts, a case has been registered against the petitioners in Crime No.24 of 2019, on the file of All Women Police Station, Tambaram and after completing the investigation final report was filed before the Judicial Magistrate, Tambaram in C.C.No.230 of 2022 and the petitioners have also appeared before the concerned Court. Pending the above said case, the second complaint has been given by the defacto complainant on the very same set of facts. He would further submit that the petitioners have already been granted anticipatory bail in the above said Crime No.24 of 2019, by which https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.15080 of 2022 the first petitioner was directed to deposit a sum of Rs.1,50,000/- to the credit of Crime number, which was also complied by the him and the copy of the receipt has also been produced.

3. Since the petitioners have already been granted anticipatory bail in connected matter for the very same set of a facts, the second anticipatory bail cannot lie. But, however, the earlier anticipatory bail granted to the petitioners will be applied to the present crime number also.

4. With the above observation, this Criminal Original Petition is disposed of.
