custody on 07.06.2025 for the offence punishable under Sections 309(4) and 312 of BNS 2023, in Crime No.94 of 2025 on the file of the respondent police, seeks bail,

The case of the prosecution is that on 07.06.2025 at about 01.30 a.m., the petitioner along with other accused persons have trespassed into the house of the defacto complainant and attempted to commit robbery by showing a knife and attacked the defacto complainant and his family member and caused injuries. Further, the accused persons were caught red-handed by the villagers. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any stringent conditions that may be imposed by this Court. He further submitted that the petitioner is in judicial custody from 07.06.2025. Hence, he seeks bail to the petitioner.
4. The learned Government Advocate (Criminal Side) submitted that the petitioner along with A1 have forcibly entered into the house of the defacto 2/4
complainant and tried to commit theft by showing the deadly weapons and brutally attacked the defacto complainant and his family members and caused injuries to them. He further submitted that the accused persons were caught redhanded by the public and A3 has escaped from the scene of occurrence. He further submitted that there is one previous case pending against the petitioner and the investigation is at initial stage. If he released on bail, he may be abscond. Hence, he opposed for grant of bail to the petitioner. Hence, he strongly opposed for grant of bail to the petitioner.
5. Considering the facts and circumstances of the case and also the fact that the petitioner has committed serious offence and the investigation is at preliminary stage. Further, if enlarging the petitioner on bail at this point of time, when the offence is serious in nature and there is likelihood of the petitioner indulging in activities which would be prejudicial for investigation and considering the bad antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner. 3/4
