P RAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 4 sanction one post of Office Assistant to the 5th respondent School namely, Devi Higher Secondary School, Kunnamgal, Kanyakumari District, and approve the appointment of the petitioner as office Assistant in the 5th respondent school w.e.f., 15.11.2000 and disburse grant-in-aid towards the petitioner's salary and other monetary benefits. ORDER
This writ petition has been filed for a mandamus, seeking for a direction to the respondents 1 to 4 to sanction one post of Office Assistant to the 5th respondent School and to approve the appointment of the petitioner as office Assistant in the 5th respondent school, within a time frame to be fixed by this Court.

2. The petitioner, prior to the filing of this writ petition, had given a representation to the respondents for the aforementioned purpose. Since the representation was not considered, the petitioner has filed this writ petition.
3. No prejudice will be caused to the respondents, if the petitioner is allowed to give a fresh representation for the aforementioned purpose to the respondents and a direction is issued to the respondents to consider the same on merits and in accordance with law, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner's representation.

For the foregoing reasons, this Court directs the petitioner to submit a fresh representation to the respondents 1 to 4 requesting them to sanction one post of Office Assistant to the 5th respondent School namely, Devi Higher Secondary School, Kunnamgal, Kanyakumari District, and to approve the appointment of the petitioner as office Assistant in the 5th respondent school w.e.f., 15.11.2000, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the same, the 3/6
first and second respondents are directed to pass final orders on merits and in accordance with law, within a period of twelve weeks thereafter.
6. With the above direction, this writ petition is disposed of. No costs.
