ORDER
The present writ petition has been filed for a Mandamus, directing the official respondents to survey and demarcate the property.
2. The petitioner is claiming right over the property in S.No.76/5 measuring an extent of about 111 cents (45.15 ares) situated at Ayyanarkulam Village, Usilampatti Taluk, Madurai District. The said property originally belonged to the petitioner's grandfather who was having three sons and two daughters namely, Raja(Deceased), Kasimayan (petitioner's deceased father), Palani, Subbulakshmi, Chellapappu (deceased). The petitioner's father namely, Kasimayan died on 06.11.2012 leaving behind the petitioner and his sister Bharathi. The petitioner further submitted that during the life time of his grandfather, the petitioner's grandfather executed a registered settlement deed in Document No.608/2019 to an extent of 54 cents in favour of his grandsons namely, R.SenthilKumar, R.Saravanakumar and R.Keyakumar who are sons of deceased late Raja. The aforesaid legal heirs of Raja sold 2/6
54 cents in favour of the 3rd respondent vide Document No.762/2025. However, the remaining portion is retained by the entire family members and they are in possession of the property. A joint patta stands in the name of petitioner's grandfather and the 3rd respondent. Now the petitioner's family is seeking to survey the property which is retained by the family and made an online application.
3. Therefore, the 1st respondent / Tahsildar is directed to survey the property after issuing notice to the petitioner, 3rd respondent and also all the legal heirs. In case, the Tahsildar is seeking police protection, the jurisdictional police shall provide the same. The said exercise shall be completed within a period of three months from the date of receipt of a copy of this order.
4. This Court is directing the 1st respondent to adhere to the following Standard Operating Procedures:
a.
The 1st respondent shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving 3/6
the notice of survey.
b.
After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.
c.
If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest.
The aforesaid procedure shall be strictly followed by the parties.
5. With the above direction, the Writ Petition is disposed of. No costs.
