ORDER

The present writ petition has been filed seeking a mandamus directing the respondents to approve the nomination of the petitioner as educational agency and Secretary of School Committee of the petitioner School. 2.A perusal of the records reveals that one Mr.Vallinayagam was the approved educational agency of the petitioner School. He passed away in the year 2002 leaving behind his wife and his three sons as his legal heirs. Thereafter, the widow of the deceased Vallinayagam and his three sons have entered into an agreement on 25.09.2008 agreeing among themselves to rotate the education agency.

3.According to the learned counsel appearing for the writ petitioner, the mother namely Muthammal and his other two brothers namely Boopathynathan and Thirikudarajan have passed away. The only surviving legal heir is one Mr.V.Ganesha Moorthy. He further submits that as and when any fresh proposal emanates from the legal heirs of Vallinayagam, the authorities have to issue notice to all the legal heirs of Vallinayagam. After considering their objections and the agreement dated 25.09.2008, the application for approval of the educational agency and secretaryship may be considered.

4.In view of the above said facts, the respondents authorities are directed to consider the proposal for approval of educational agency of the petitioner School after considering the claim made by all the legal heirs of Vallinayagam.

5.With the above said observation, this writ petition stands disposed of. No costs.
