ORDER

The present application has been filed to condone the delay of 172 days in preferring the review application as against the order of this Court, dated 13.12.2024 made in W.P(MD)No.24349 of 2024, wherein, this Court has directed the review applicant herein to retain a sum of Rs.5,00,000/- and release the balance amount to the writ petitioner.

2. The present review application has been filed on the ground that there is no prayer in the writ petition to settle the terminal benefits and the writ petitioner has not exhausted the alternative remedy provided under the Tamil Nadu Co-operative Societies Act, 1983. 2/4

3. Admittedly, the writ petitioner has retired from service and her terminal benefits has not been released on the ground that surcharge proceedings are pending. Orders have been passed in the surcharge proceedings. The writ petitioner has already deposited a sum of Rs.60,000/-. Under the surcharge proceedings, the petitioner is liable to pay a sum of Rs.2,91,500/-. This Court by an order, dated 13.12.2024 has permitted the review applicant to retain a sum of Rs.5,00,000/- out of the terminal benefits and release the balance amount. This Court does not find any error apparent in the said order. Therefore, the condone delay application stands dismissed. Consequently, the review application also stands dismissed at the SR stage itself. There shall be no order as to costs.
