For Petitioner : Mr.Raja Karthikeyan For R1 : Mr.P.Kottaichamy, Government Advocate (Crl. Side) COMMON ORDER The petitioner, who is the accused in Crime Nos.49 of 2023, 22 of 2024 and 1 of 2025, has filed these petitions to quash the FIR in Crime Nos. 49 of 2023, 22 of 2024 and 1 of 2025.
2. The learned counsel appearing for the petitioner submits that the petitioner is a College Student studying B.A.(Tamil) in a College. According to him, the petitioner is having a Swaraj Tractor, which has been seized by the respondent Police in the year 2023 and they have foisted a false case as against him with the tractor in Crime No.49 of 2023. petitioner has raised certain objections with the respondent Police for having foisted this false case against him in Crime No.49 of 2023. Therefore, according to him, other two cases in Crime Nos.22 of 2024 and 1 of 2025 were foisted as against the petitioner. The learned counsel has also pointed out that the petitioner was not present in the place of occurrence in the commission of offence as pointed in Crime Nos.22 of 2024 and 1 of 2025. Further, the Call Details Report would reveal that the petitioner was not present in the place of occurrence as alleged in Crime No.22 of 2024 and 1 of 2025. Therefore, the petitioner has moved these petitions to quash the proceedings in Crime No.49 of 2023, 22 of 2024 and 1 of 2025.
3. The learned Government Advocate (Crl. Side) submits that apart from these three cases, the petitioner is also an accused in Crime No.72 of 2023 on the file of the respondent Police for the offence under Sections 147, 148, 341, 431 of IPC and Section 3 of TNPPDL Act. The respondent Police has recovered minerals and also the vehicles involved in the commission of offence. He further submits that the investigation in Crime No.22 of 2024 has already been completed and final report has also been filed before the learned Judicial Magistrate, Kadaladi. With regard to two other cases in Crime Nos.49 of 2023 and 1 of 2025, the investigation in both the cases 4/7
have already been completed and final reports are yet to be filed.
4. This Court considered the rival submissions made.
5. The petitioner has moved these petitions that all the cases have been foisted as against him. The respondent Police claims that they have recovered the minerals and also the vehicles in the commission of offence. According to the learned Government Advocate (Crl. Side), all the cases are relating to the illegal theft of river sand.
6. The grounds raised by the petitioner can be appreciated only during the trial. The petitioner is involved in three cases apart from the case in Crime No.72 of 2023. Therefore, this Court is not inclined to interfere with the proceedings at the stage of investigation, based on the grounds raised in support of these petitions. Therefore, all the Criminal Original petitions are dismissed. However, there shall be a direction to the concerned Deputy Superintendent of Police to ensure that the final reports are filed in a separate manner for the offence under Section 379 IPC by the police report and by a private complaint, for the offence under Section 21(1) of the Mines and Minerals (Development and Regulation) Act 1957.
