For Respondent : Mr.T.Senthil Kumar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.248 of 2022 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner is facing charges under Sections 8(c) and 20(b) (ii)(A) of Narcotic Drugs and Psychotropic Substances Act, 1985, in Crime No.248 of 2022 on the file of the respondent police. 2.The earlier petition that was filed by this petitioner came to be dismissed on the ground that the petitioner was stated to be misused the juvenile for the purpose of selling the contraband. Noting the grievous nature of the offences only, the earlier application was dismissed. Now, this is the second anticipatory bail application that has been filed by this petitioner without any change of circumstances.
3.The learned counsel for the petitioner would submit that there was no bad antecedents reported against the petitioner and no previous cases of similar in nature is also pending. 4.However, on the basis of the confession statement of the aforesaid juvenile, the involvement of this petitioner came to light and only on that ground, he has been implicated. When serious allegation of misusing the juvenile has been made, the discretionary relief of anticipatory bail cannot be extended to the petitioner. I find no merit in this petition and the petitioner has to surrender https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.15279 of 2022 either before the respondent police or before the concerned Court and can seek regular bail.
