PRAYER: Contempt Petition is filed under Section 11 of the Contempt of Courts Act, praying to punish the respondents herein for their willful disobedience of the order passed by this Court in W.P.(MD).No.3003 of 2019, dated 26.02.2019.

This Contempt Petition has been filed to punish the respondents for their willful disobedience of the order passed by this Court in W.P. (MD).No.3003 of 2019, dated 26.02.2019.

2. This Court, by order dated 26.02.2019, directed the respondents in W.P.(MD).No.3003 of 2019 to dispose of the representation submitted by the petitioner, dated 21.12.2018, seeking compensation for the acquisition of Boosthathi road belonging to him, on merits and in accordance with law, within a period of eight weeks from the date of receipt of that order.

The Commissioner, Tirunelveli Corporation has rejected the claim of the petitioner, in Na.Ka.No.TP3/L2/1941/2019, dated 03.08.2022, on the ground that it is an unapproved lay out and the roads and other common places were not handed over to the Corporation and the Corporation has not laid any road and hence, the petitioner is not entitled for any compensation. Therefore, the Contempt Petition is closed.

4. The learned counsel appearing for the petitioner seeks liberty to challenge the said rejection order. It is left open to the petitioner to challenge the rejection order of the Commissioner, dated 03.08.2022, in accordance with law, if so advised.
