ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 191(2), 191(3), 296(b), 118(1) and 351(3) of

BNS 2023, in Crime No.163 of 2025 on the file of the respondent police, seek anticipatory bail.

2. The prosecution's case is that during temple festival on 30.06.2025 at about 08.00 a.m., there was a wordy quarrel between the petitioners and the defacto complainant, as a result of which, the petitioners along with other accused persons have attacked the defacto complainant with wooden log and caused injuries to him. Hence, the complaint.

3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have not committed any offences as alleged by the prosecution. He further submitted that the petitioners are ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seek anticipatory bail to the petitioners.

4. The learned Government Advocate (Criminal Side) submitted that the injured person is still in hospital and the arrested accused still in judicial custody. He further submitted that the investigation is still pending. Hence, he opposed for grant of anticipatory bail to the petitioners.

5. Considering the facts and circumstances of the case and also the fact that nature of the offence committed by the petitioners, the victim is still in hospital. Further, the petitioners have committed serious offence and the investigation is still pending and the custodial interrogation is very much required. Further, if the

petitioners are released on bail, they may tampering the witnesses and abscond. Hence, this Court is not inclined to grant anticipatory bail to the petitioners.
