ORDER

The subject matter of challenge in the present Writ Petition pertains to the proceedings of the first respondent, dated 28.10.2020, and for a consequential direction to the respondents to grant recognition to the petitioner School within the time stipulated by this Court.

2. When the matter was taken up for hearing, the learned counsel appearing on behalf of the petitioner submitted that the recognition was not granted by the first respondent, by pointing out certain mandatory requirements not being fulfilled by the petitioner School. The learned counsel appearing on behalf of the petitioner submitted that all the shortcomings have been rectified and a fresh application/representation was submitted on 11.01.2021. The learned counsel for the petitioner submitted that a direction can be given to the first respondent to deal with the said application and to grant recognition to the petitioner School. 2/4

Taking into consideration the facts and circumstances of the case and the subsequent development, there shall be a direction to the petitioner to submit a fresh application before the first respondent. On receipt of the same, the first respondent shall act upon the application and take a decision within a period of three months thereafter in accordance with law.

4. This Writ Petition is disposed of with the above direction. No costs. Consequently, connected Miscellaneous Petition is closed. It is made clear that the first respondent should not be influenced by the earlier proceedings, which has been challenged in this Writ Petition and the application shall be dealt with afresh after proper application of mind.
