PRAYER:Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the official respondents 2 to 4 restraining the respondent Nos.5 to 7 from encroaching the public cart track situated in Survey Nos.1330, 1331, 1332 and 1333, Keezhanilidanallur Village, Sankarankovil Taluk, Tenkasi District and also restore the classification of the cart track situated in the above said survey number in the present revenue records as per the FMB and Village Map issued by the first respondent department by considering the petitioner representations dated 30.07.2022.

ORDER
(Order of the Court was made by J.NISHA BANU, J.) This writ petition is filed to forbear private respondents herein from encroaching upon the public cart track situated in Survey Nos.1330, 1331, 1332 and 1333, Keezhanilidanallur Village, Sankarankovil Taluk, Tenkasi District and also restore the classification of the cart track in the present revenue records. 2.The petitioner claims that he has made a representation dated 30.07.2022 before the authorities concerned seeking to remove the encroachment 2/5
made by the respondents 6 to 8 in the petition mentioned property. But till today, the representation of the petitioner is kept pending without any progress. 3.The learned Additional Government Pleader appearing on behalf of the respondents 1 to 5, submits that the representation of the petitioner would be considered and appropriate orders would be passed in accordance with law within a period that may be stipulated by this Court. 4.Considering the limited scope of the prayer sought for by the petitioner, without expressing any opinion on the merits of the claim made by the petitioner either in the representation or in the affidavit filed in support of the Writ Petition, this Writ Petition is disposed of with a direction to the fourth respondent to consider the representation of the petitioner dated 30.07.2022 by giving an opportunity of hearing to the petitioner as well as the respondents 6 to 8 and pass appropriate orders on merits and in accordance with law within a period of twelve [12] weeks from the date of receipt of a copy of this order. No costs.
