Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent to pay the petitioner the amount payable towards the encashment of 111 days of earned leaves surrendered by her deceased husband/employee (Late) A.Lourdu Xavier Jones, Staff No.K2D010072 in the years before his death, as admitted by the respondent in the settlement of account dated 17.06.2023, either based on his monthly wages of the respective months of surrender of those earned leaves, together with 18% interest p.a. from the respective due dates or based on the monthly wages payable to him on the month of his death, together with 18% interest from the date of his death, within a time frame.

O R D E R

The present Writ Petition has been filed by the wife of the deceased driver, who was working in the respondent Transport Corporation seeking a Mandamus for disbursement of the surrender leave and other benefits.

2. In fact, the respondent Corporation has admitted about the non payment of the earned and surrender leave in their proceedings dated 17.06.2023.

3. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondent.

4. Considering the above said facts, the respondent is directed to disburse the eligible amount along with interest at the rate of 6% p.a., from the due date till the date of realization within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs.
