PRAYER :- For Bail in Crime No.11 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Sole Accused, who was arrested on 22.06.2023 for the offences punishable under Sections 354(A)(1)(i), 365, 376 r/w 511 of IPC, in Crime No.11 of 2023, on the file of the All Women Police Station, Kumbakonam, Thanjavur District, seeks interim bail.

2.The case of the prosecution is that on 17.06.2023, the accused went to the Government Hospital, Kumbakonam, to see the defacto complainant's father, who 1/3

was taking treatment there. At that time, he demanded her parents to send the victim along with him for giving breakfast to her deceased father. But, she was took to the accused's house, where she was sexually abused. Hence, the complaint. 3.On medical grounds the petitioner was released on interim bail and surrendered before the Superintendent of Prison, District Jail, Pudukottai on 07.09.2023, as per the order of this Court. The learned Additional Public Prosecutor, would submit that investigation is still pending, though the statutory period is over. 4.In view of the above, without going into other aspects, this Court is inclined to grant bail to the petitioner with certain conditions. 5.

Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Kumbakonam, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
