PRAYER :- For Bail in Crime No.234 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused herein, who was arrested on 21.07.2022 for the alleged offence under Sections 2949b), 324, 307, 506(ii) IPC, in Crime No.234 of 2022, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that there was matrimonial dispute between the daughter of the defacto complainant and accused. Therefore, the daughter and her child were living in the house of the defacto complainant. The accused used to visit the house of the defacto complainant to visit his child and to take back his wife. On 18.07.2022 at about 09.30PM, there was trouble arose between the husband and wife, in which, the accused assaulted the defacto complainant and his family members with knife and threatened with dire consequences. Hence, the case.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. The petitioner is in custody ever since from the date of his arrest, ie., on 21.07.2022. https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.15076 of 2022 4.The learned Additional Public Prosecutor submitted that there was no previous motive between the parties and the occurrence took place on sudden provocation. The injured was discharged from the hospital. The petitioner is not having any previous case at his credit.
5.Considering the relationship between the parties and there was no previous motive between them and also considering the period of incarceration, this Court is inclined to grant bail to the petitioner with stringent conditions.
6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Bodinayakanur, Theni District, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders. Further, the petitioner is directed to settle the issue between them.
