Prayer :- Criminal Original Petition filed under section 528 of BNSS to call for the records relating to the impugned proceedings in C.C.No. 177 of 2019 on the file of the Judicial Magistrate Court, Kadaladi pending disposal of the above Criminal Original Petition and quash the same and pass such further or other orders as this Honourable court may deem fit and proper in the circumstances of the case and thus render justice.
ORDER:- This Criminal Original Petition coming on for hearing on this day Monday, the caption for "Extension of time" and upon perusing the earlier order of this court dated 16.08.2024, and the requisition letter submitted by the District Munsif CUM Judicial Magistrate, Kadaladi vide letter in D.No.444/2025 dated 1/4
18.03.2025, and through the Principal District Judge,Ramanathapuram, D.No.A1/1591/2025, Dated 20.03.2025, this Court made the following order: "The learned District Munsif cum Judicial Magistrate, Kadaladi(FAC) by his letter dated 18.03.2025 has sought further time to dispose of the case in C.C.No.177 of 2019.
2. This Court had already directed the learned District Munsif cum Judicial Magistrate, Kadaladi(FAC) to dispose of the case in C.C.No.177 of 2019 within a period of three months from the date of receipt of the order. The learned District Munsif cum Judicial Magistrate, Kadaladi(FAC) in his letter stated that the order copy was received by the Court on 17.12.2024 and the case is pending for trial, because of non availability of counsel for the accused. Further the accused filed representation for appointment of legal aid counsel and now the counsel was appointed thereby unable to dispose the case within the time stipulated by this Court.
3. Considering the request made by the learned District Munsif cum Judicial Magistrate, Kadaladi(FAC) and also considering the facts and circumstances of the 2/4
case, time already granted by this Court to dispose the case in C.C.No.177 of 2019 is extended by another three months from the date of receipt of a copy of this order.
