1.The Sub Registrar, Sub Registrar Office, Near to New Bus Stand, Theni.
2.The District Registrar, District Registration Officer, Theni District, Periyakulam.
... Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the 1st respondent herein to carry out the cancellation of settlement deed as per the decree dated 03.01.2013 made in O.S.No.12/2012 on the file of the District Munsif Court, Theni by considering the petitioner's representation dated 14.07.2022. For Petitioner : Mr.K.Hemakarthikeyan For Respondents : Mr.K.S.Selvaganesan Additional Government Pleader 1/4
ORDER
Heard the learned counsel on either side.
2. The petitioner wants the first respondent to register the petition mentioned decree. The petitioner is not a party to the said decree. Therefore, I am not inclined to consider the petitioner's request.
3. O.S.No.12 of 2012 on the file of the District Munsif Court, Theni was instituted by one Indra through her power agent Prabhu. If Indra or Prabhu or the defendants in the suit present a decree, then of-course the first respondent has to register the same subject to fulfilment of the usual formalities. It is well settled that limitation period of two months set out in Section 23 of the Registration Act will not apply to the decrees of Court. Therefore, the petitioner has to work out his right in the manner known to law.
4. Leaving open the same, the Writ Petition is disposed of. No costs. 24.08.2022 Index : Yes / No Internet : Yes/ No rmi To 1.The Sub Registrar, Sub Registrar Office, Near to New Bus Stand, Theni.
