ORDER
This writ petition has been filed challenging the order passed by the fourth respondent, dated 16.06.2025 and consequently direct the fourth respondent not to provide to electricity connection in the name of fifth respondent in S.F.No.142/7A1 of Vakavasal Village, Pudukkottai District and direct the third respondent to implement the order passed by the first respondent in Na.Ka.Pa.Mu.T512738/2018 dated 14.06.2023.
2. The petitioner claims to have purchased the property from one Mr.Sivasamy, the father of the fifth respondent by virtue of sale deed dated 2/6
01.12.2005 registered as Document No.3900/2005. The sale was effected by the fifth respondent's father based on alleged oral partition between the fifth respondent's grandfather, namely, Rengan and his three sons including the fifth respondent's father. The patta stands in the name of the fifth respondent's grandfather was subsequently transferred to the name of the petitioner pursuant to the aforesaid sale deed registered in favour of the petitioner.
3. The fifth respondent on the other hand claims a right over the property. The fifth respondent has now applied for an electricity connection for a small dwelling unit on the subject land.
4. The petitioner has filed a suit in O.S.No.119 of 2018 before the District Munsif Court, Pudukottai for declaration. Meanwhile, the patta issued in the name of the petitioner has been restored back in the name of the original land owner, Rengan, grandfather of the fifth respondent. The operative portion of the order of the District Revenue Officer restoring the patta in the name of the Rengan reads as under: 3/6
5. Considering the same, the petitioner's prayer in this writ petition cannot be countenanced. Therefore, the writ petition stands dismissed. The rights of the petitioner, fifth respondent and others in the above suit to be determined in the manner known to law. In case any power connection given to the fifth respondent, the same shall be subject to the final out come of suit in O.S.No.119 of 2018 filed by the petitioner. It is open for the petitioner to 4/6
take suitable steps to challenge the order of the District Revenue Officer in the manner known to law. No costs. Consequently, the connected miscellaneous petition is closed.
