ORDER

This Writ Petition has been filed forbearing the respondent/Commissioner, Pudukkottai Municipality, from constructing weigh bridge in Town Survey No.3594, New Palace Road, Pudhukottai.

2.According to the petitioner, the respondent Municipality leased out a small extent of land measuring an extent of 120 x 100 ft in Town Survey No.3594, New Palace Road, Pudukkottai to the petitioner on 06.07.2006 and periodically, the lease has been extended and the lease is still valid till 2018. In the meantime, the respondent Municipality is taking steps to construct a weigh bridge in the above said survey number. Hence, this writ petition. 3.Today, when the matter is taken up for hearing, the learned Standing Counsel appearing for the respondent Municipality submitted that the Municipality is not proposing to construct a weigh bridge in the property leased out to the petitioner and they are proposing to construct the weigh bridge in some other area in the same survey number. Hence, the apprehension of the petitioner is not genuine.

4.In view of the submission made by the learned counsel for the respondent that they are not going to construct a weigh bridge in the area leased out to the petitioner, there is no further orders necessary in this writ petition.
