ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) This Writ Petition has been filed seeking a direction to the respondents to complete the Road Work, Pavoorchathram Railway over bridge work and Alangulam Lake bridge Work, which are all carrying on 2/6

for strengthening and widening (four lane) in Tirunelveli-SengottaiKollam Road (SH-39), within the time which may be fixed by this Court by considering petitioner's representation dated 30-06-2023.

When the matter is taken up for hearing, the 6th respondent has filed a status report, wherein it is stated as follows: "The project work is including the construction of ROB @ Km 44/169 of SH 39 at Pavoorchatram L.C No.83 which is in progress. Though the ROB location is located within the dense built-up portion of Pavoorchatram, the works are being carried out by duly considering the safety of road users and traffic diversion. The railway works are being executed under the supervision of southern railway officers. As per contract agreement, Out of 44 Nos of deck slabs, we completed 40 Nos of ROB deck slab works except adjacent spans (4 Nos) on both sides which could be commenced only after the completion of ROB railway span. The foundation works inside railway portion reduces the available road carriageway width near the level crossing zone. Hence, Two-way traffic is very difficult near railway track during the execution of railway portion works. Hence, the commercial vehicles and buses have been diverted for the safety of road users.

At present, the sub-structure works for the South side ROB are completed and the sub-structure works for the North side ROB are nearing completion. The fabrication of girders for (south side) ROB super structure are completed by RDSO approved vendor M/s. Contech Engineers pvt. Ltd., @ yard, Pudukottai. (Engaged by EPC contractor). Now, Awaiting for the inspection of Railway special wing (RDSO), Lucknow. Thereafter, the fabricated steel girders will be transported to the site and it will be placed over the railway piers.

Despite the tedious works involved in the Pavoorchatram ROB work due to its construction very near to the existing level crossing, we are taking immense steps to complete the balance ROB works at the earliest. It is respectfully submitted that the requests of petitioner have been already considered. The road works and other bridge works (Except railway portion of ROB) are completed. Also, the ROB works inside railway portion are already expedited to put into public use at the earliest."

3. Recording the said status report, as the road works and other bridge works have been completed and the ROB works inside the railway portion have been expedited to be put into public use at the earliest, no further direction is required in this Writ Petition. 4/6

4. Accordingly, this Writ Petition is closed. The respondents are directed to complete the ROB works inside the railway portion, as expeditiously as possible. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
