Mr.T.Senthil Kumar, Additional Public Prosecutor. PETITION FOR ANTICIPATORY BAIL UNDER SEC 482 of BNSS PRAYER :- For Anticipatory Bail in Crime No.9 of 2024 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 120(b), 419, 420, 423, 465, 468 and 471 IPC in Cr.No.9 of 2024, seeks anticipatory bail. 2.The case of the prosecution is that the defacto complainant is the second wife of one Periyasamy. The said Periyasamy purchased four housing plots at Mekkudi village, in the year 1986. After the demise of Periyasamy, she and her children inherited the said properties. She came to know that one Selvam entered into a sale agreement with one Vijayarajan and planned to sell her properties. In this regard, she made an objection before the Sub-Registrar, Sathanur. On 09.06.2023, when she 1/3

verified the entries in the encumbrance certificate, she came to know that A1 made impersonation pretending to be the owner of the property and sold the said housing plots in favour of the petitioners. Further, A1 fabricated a death certificate as well as legal heir certificate, as if he is the legal heir of the defacto complainant's husband. The other accused stood as witnesses to the said documents. A10 and A11 are Sub Registrars. Hence, the complaint.

3.Heard the learned counsel on either side and perused the material records of the case.

4.As per the allegation, by impersonating the sale deeds were registered and subsequently transferred. The specific allegation as against the petitioner/A12 is that he is acting as a broker and has created fake identity cards and documents so as to facilitate the impersonation. In the teeth of the allegation, I'm not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
