Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the Respondents to take appropriate action against the authorities and individuals, who have trespassed into land in Patta No.3597 and 3598 in Survey No.1200/1C and 1200/1A in Aathoor Village, Dindigul District and to disburse adequate amount of compensation for the damages caused by way of erecting heavy transmission line without the knowledge of the Petitioner in accordance with law within time frame fixed by this Court.

O R D E R

This Writ Petition has been filed seeking direction to the Respondents to take appropriate action against the authorities and individuals, who have trespassed into land in Patta No.3597 and 3598 in Survey No.1200/1C and 1200/1A in Aathoor Village, Dindigul District and to disburse adequate amount of compensation for the damages caused by way of erecting heavy transmission line without the knowledge of the Petitioner in accordance with law within time frame fixed by this Court.

2.Heard Mr.R.Alagumani, learned counsel appearing for the petitioner, Mr.D.Gandhiraj, learned Special Government Pleader appearing for the respondents 1, 3, 4, 5 & 8 and Mr.S.Deenadhayalan, learned Standing Counsel appearing for the respondents 2, 6 & 7.

3. It is the case of the petitioner that without any permission, the respondents have erected the Transformer in the patta land of the petitioner. However, so far no compensation has been paid to the petitioner. In this regard, he has submitted several representations seeking compensation before the National Highways Authority of India as well as the District Collector. However, the same 3/6

were not considered. Hence, this writ petition has been filed. 4.Since the District Collector is the competent authority under the Indian Telegraph Act, 1885, the District Collector/3rd respondent is directed to consider the representation of the petitioner and pass appropriate orders as per Rules within a period of one month from the date of receipt of copy of this order.

5. With the above direction, this writ petition is disposed of. No costs.
