Assistant and consequential notification issued by the third respondent in Advertisement No.1/2021, dated 09.09.2021, insofar as Clause 5 prescribing the maximum age limit as 40 is concerned, as arbitrary, irrational, unconstitutional and consequently allow the petitioners to participate in the selection to the post of P.G. [Order of the Court was made by M.DURAISWAMY.,J.] The Petitioner has filed the above Writ Petition to issue a Writ of Declaration, declaring Rule 6 of Special Rules of Tamil Nadu Higher Secondary Educational Service notified in G.O.Ms.No.14, School Education Department, dated 30.01.2020, prescribing the maximum age limit as 40 for direct recruitment to the post of P.G. Assistant and the consequential notification issued by the third respondent, dated 09.09.2021, insofar as Clause 5 prescribing the maximum age limit as 40 is concerned, as arbitrary, irrational, unconstitutional and consequently allow the petitioners to participate in the selection to the post of P.G. Assistant. 2.When the Writ Petition is taken up for hearing today, Mr.G.

Sankaran, learned Counsel appearing for the Petitioner submitted that the Writ Petition seeking for the similar relief was filed before the Principal Seat today in W.P.No.21983 of 2021 and the same was dismissed by the Division Bench of the Principal Bench today, hence, the Writ Petition may be dismissed following the order passed in W.P.No.21983 of 2021.

3.In view of the submission made by the learned Counsel for the Petitioner, the Writ Petition is dismissed, following the order passed in W.P.No.21983 of 2021. No costs. Consequently, the connected Miscellaneous Petitions are dismissed.
