PRAYER :- For Bail in Crime No. 288 of 2019 on the file of the Respondent Police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioner is arrayed as A4. He is in custody since 14.06.2019 for the offences punishable under sections 8(c), 20(b) (ii)(c), 25 and 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.288 of 2019 on the file of the respondent police. He seeks bail.

3.The quantity of ganja involved in this case is 21 KG. Therefore, the petitioner has to satisfy the requirements set out in https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.12247 of 2019 Section 37 of NDPS Act. The petitioner is having two previous cases. Both the cases involved commercial quantity. Therefore, this Court cannot give a finding that the petitioner will not repeat the offence. The final report has already been filed. Trial is yet to be commenced.

4.Taking note of all these aspects, this criminal original petition stands dismissed.
