For Respondent : Mr.R.Meenakshi Sundaram, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- C-29AB. For Anticipatory Bail in Crime No. 442/2020 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/accused No.4, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) and 20(b)(ii)(B) of NDPS Act, 1985 in Cr.No.442 of 2020, seeks anticipatory bail.

2.The case of the prosecution is that after receiving secret information, on 01.06.2020 at about 06.00a.m., the police party went to Viralipatti to A.Vadipatti Road, near temporary check-post and at that time, the accused came in a two wheeler and on search being made, the police party found that the accused possessed 18.500kgs of ganja and they recovered the same. Hence, the present complaint.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him. Hence, he seeks anticipatory bail to the petitioner. 4.The learned Additional Public Prosecutor appearing for the State would submit that this is the fourth application seeking https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.17421 of 2021 anticipatory bail, that the petitioner is A.4 in this case, that A.1 and A.2 were already arrested and released on bail, that the petitioner is the main supplier and that the investigation is yet to be completed. He would further submit that the petitioner is having four previous cases, out of which, two cases are similar in nature.

5. Considering the seriousness and the gravity of the offences, that the investigation is pending as stated by the learned Additional Public Prosecutor and that the petitioner is having two previous cases for similar offences, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
