PRAYER: Appeal filed under Section 28 of the Hindu Marriage Act and Section 19 of the Family Courts Act, to call for the records in pursuant to the fair and decreetal order dated 17.08.2021 passed in I.A. No.1 of 2020 (I.A.No.90 of 2020 ) in HMOP No. 33 of 2019 on the file of the Family Court, Srivilliputhur and set aside the same and to allow this appeal.

JUDGMENT

[Judgment of the Court was made by P. VELMURUGAN, J.] This Civil Miscellaneous Appeal has been filed challenging the interlocutory order passed in I.A. No.1 of 2020 (I.A.No.90 of 2020 ) in HMOP No. 33 of 2019 on the file of the Family Court, Srivilliputhur

2. No appeal will lie against interlocutory order passed by the Family Court which is barred under Section 19 of the Family Courts Act, 1984. The impugned order passed by the Family Court in I.A. No.1 of 2020 (I.A.No.90 of 2020 ) appears to be an interlocutory order and therefore, this Civil Miscellaneous Appeal is not maintainable.. However now the main petition in HMOP No.33 of 2019 itself was disposed of on merits, under these circumstances, the relief sought for in this appeal has become infructuous.

3. In view of the same, this Civil Miscellaneous Appeal stands dismissed as infructuous.

No costs. Consequently connected miscellaneous petition stands closed.
