PRAYER: Criminal Original Petition is filed under Section 528 of BNSS, 2023, to direct the fourth respondent not to harass the petitioner and consequently direct the respondents to clear the petitioner's travel to Dubai based on his representation dated 08.06.2026 and pass such other or further orders as this Court may deem fit.

ORDER

The present petition has been filed seeking a direction as against the fourth respondent herein to clear the petitioner's travel to Dubai based upon his representation dated 08.06.2026.

2. According to the learned Senior Counsel appearing for the petitioner, the petitioner is an accused in Spl.S.C.No.988 of 2025 on the file of the Special Courts in the cadre of District Judge for Exclusive Trial of Cases 2/5

under POCSO Act, Thanjavur, wherein he is charged with the offences under Sections 5(L), 5(j) (ii) r/w.Section 6(1) of POCSO Act and Section 351 (2) of BNS.

3. According to the learned Senior Counsel appearing for the petitioner, when he made an attempt to go to Abudhabi, the fourth respondent had intercepted him and brought him back to India and therefore, the present application has been filed.

4. Considering the fact that already charge sheet has been taken on file by the Special Courts in the cadre of District Judge for Exclusive Trial of Cases under POCSO Act, Thanjavur, it would only be appropriate for the petitioner to approach the concerned Court seeking permission of the Court to go abroad. The respondent police officials are directed to strictly comply with the orders of the concerned trial Court.

5. With the above said observations, this Criminal Original Petition stands disposed of.
