O R D E R

This Criminal Original Petition has been filed for issuing a direction to the respondents 1 and 2 not to harass the petitioner and his family members, in the guise of enquiry by interfering with the subject matter of the pending civil suit, on the basis of the petitioner's representation, dated 20.08.2019.

2. It is seen that there is a dispute between the family members with regard to properties. In this regard, they have also filed a suit in O.S.No. 16 of 2019, in which, the respondent Nos. 3 and 4 are the parties. On the complaint lodged by the respondent Nos. 3 and 4, the 2nd respondent calling the petitioner and also harassing them to settle the issue.

3. Admittedly, the civil suit is pending between the parties and as such the second respondent has no role to play in this case.

4. I have heard Mr. T. Vadivelan, learned counsel appearing for the petitioner and Mr. K.Suyambulinga Bharathi, learned Government Advocate (Crl. Side) appearing for the respondent 1 and 2.

5. Considering the facts and circumstances of the case, this court directs the 2nd respondent not to harass the petitioner under the guise of enquiry on the complaint lodged by the defacto complainant.

6. With the above observations and direction, this Criminal Original Petition is disposed of.
