Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the third respondent to accept full amount of medical bills i.e., 2,15,911.25 incurred by the petitioner in the 5th respondent hospital and recoup remaining amount of Rs.1,58,911.25 after deducting the amount of Rs.57,000/- paid by the 4th respondent to the 5th respondent Hospital either directly by the third respondent or through its 4th respondent / 3rd party administrator of the Insurance coverage within the stipulated time as fixed by this Court.

ORDER
Heard Mr.K.K.Samy, learned counsel appearing on behalf of the writ petitioner, Mr.V.R.Shanmuganathan, learned Special Government Pleader appearing on behalf of the respondents 1 and 2 and Mr.A.Shajahan, learned counsel appearing on behalf of the respondents 3 and 4.
2.Mr.V.R.Shamuganathan, learned Special Government Pleader appearing on behalf of the respondents 1 and 2 submitted that if there is any difficulty in availing treatments and non-availability of facilities, the writ petitioner has to approach the District Level Empowered Committee headed by the District Collector with Joint Director of Medical and Rural Health Services, the District Treasury Officer and a representative of the Insurance Company as member.
3.The learned counsel appearing on behalf of the writ petitioner seeks permission of this Court to withdraw this Writ Petition with liberty to approach the District Level Empowered Committee and made an endorsement to that effect. 4.Recording the endorsement, this Writ Petition stands dismissed as withdrawn with liberty to approach the District Level Empowered Committee. No costs.
