For Respondent : Mr.P.Kottai Chamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime.No.262 of 2021 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 294(b) IPC and Section 3(1) of TN PPDL Act, seeks anticipatory bail. 2.The case of the prosecution is that the petitioners had damaged CCTC cameras installed in public place and therefore, the present case came to be registered.
3. The learned Counsel for the petitioner submitted that this is the third anticipatory bail application and the earlier applications filed by this petitioner in Crl.O.P.(MD).Nos.8789 & 11876 of 2021 were dismissed on 06.07.2021 and 24.08.2021 on the ground that the petitioner is having six previous cases, but, three cases are only pending against the petitioner. https://hcservices.ecourts.gov.in/hcservices/

However, the learned Additional Public Prosecutor appearing for the respondent Police disputed the same and submitted that the petitioner is having six previous cases in (i) Crime No.250 of 2020, 436 of 2020, 62 f 2021 of the respondent Police (ii) Crime No.147 of 2020 of Kovilankulam Police Station (iii) Crime No.34 of 2018 of Elanjembur Police Station (iv) Crime No.60 of 2018 of Kadaladi Police Station.
5. Considering the bad antecedents of the petitioner and there is no change in circumstance, this Court is not inclined to grant anticipatory bail to the petitioner.
