PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to permit the petitioner to surrender and accept the bail application filed by the petitioner before the learned III Additional District and Sessions Court for PCR Cases, Madurai, consider the bail application on the same day in the event of surrender in connection with in Cr.No.15 of 2018 on the file of the 2nd respondent Police in Spl.S.C.No.199 of 2021 in accordance with law. 1/4

ORDER
The present petition has been filed by the second accused in Crime No.15 of 2018 on the file of the second respondent police in Spl.S.C.No.199 of 2021 seeking a direction as against the trial Court to consider the bail application of the petitioner on the same day of surrender.
2. Considering the averments in the petition, there shall be a direction to the learned Sessions Judge, III Additional District and Sessions Court for PCR Cases, Madurai, on or before 10.07.2026 and the learned Trial Court shall consider the bail application of the petitioner in Crime No.15 of 2018 on the file of the second respondent police in Spl.S.C.No.199 of 2021 and accept his surrender on the same day, after giving due opportunity to the defacto complainant.

3. With the above said observations, this Criminal Original Petition stands allowed.
