ORDER

This Writ Petition is filed seeking to issue Writ of Certiorarified Mandamus to call for the records pertaining the impugned order in Na.Ka.No. 79/F2/PS/2026 dated 13.06.2026 on the file of the 1st Respondent and quash the same and directing the 1st Respondent to provide adequate police protection for the temple festival of Sri Kulathukarai Muniyappasamy Temple, Anaiyur, Manapparai Taluk, Trichy District.

2. The learned counsel for the petitioner submitted that seeking permission to conduct the temple festival on 23.06.2026 and 24.06.2026, the petitioner has approached the first respondent and submitted a representation. By the impugned order dated 13.06.2026, the first respondent has rejected the petitioner's representation, citing the disputes created by some individuals regarding hereditary trusteeship involving the temple and the pending civil proceedings. Challenging the same, this writ petition is filed.

3. The learned Government Advocate (Crl.side) submitted that since an appeal has been filed by the second respondent before the HR & 2/4

CE Department, regarding the hereditary trusteeship and a petition in WP(MD)No.19156 of 2025 is pending before this Court, the petitioner's representation has been rejected.

4. Heard either sides and carefully perused the materials available on record.

5. In view of the submission made by either sides, the first respondent police is directed to put the petitioner as well as the proposed second respondent on notice under Section 64 of BNSS on or before 10.00 a.m., on 23.06.2026 and facilitate the peaceful conduct of the temple festival.
